The City Council holds its business meetings in public in accordance with the requirements of the Ralph M. Brown Act, its established policies and procedures, and its adopted parliamentary authority. The Council strives to carry out its meetings in an atmosphere of professionalism with full participation by members of the body and the public. As such, the Presiding Officer is empowered to govern City Council Meetings to foster the efficient and fair administration of City business and reserves the right to enforce (or cause to be enforced) the Meeting Rules of Conduct and Decorum as set forth in Chapter 5 of the City Council Policy and Procedures Manual.

The City Council welcomes and encourages public participation and invites the community to attend in person. Now that COVID-19 cases in our area have reduced to a point that social distancing requirements have been lifted, City Council Meetings will be held in-person at City Hall in Council Chambers.  Remote viewing of our Council Meetings is available through YouTube, but public comments must be given in-person at the meeting or in advance as noted below.

Public Comments: Members of the public may submit comments electronically to [email protected] by 4 p.m. the day of the meeting to be distributed to City Council. Participants are invited to address the Council on agendized and non-agendized topics at the beginning of the meeting. Public comments will be no longer than three (3) minutes per community member. Should a speaker conclude their comments prior to the expiration of three (3) minutes, the speaker waives the right to speak for any remaining amount of time. For further information about how to address the Council, please refer to the City’s website at victorvilleca.gov/government/agendas.

Approval of Resolution No. 23-076 – A Resolution of the City Council of the City of Victorville, Adopting and Establishing New Solid Waste Rates for Solid Waste Services and Rescinding Resolution No. 18-012    Recommendation:
That the Honorable City Council:
(1) 
Conduct the Public Hearing;
(2) 
Determine whether a Majority Protest exists at the close of the Public Hearing, and if no Majority Protest exists;
a. Make the Proposition 218 findings set forth in Section 2 of Resolution No. 23-076; and
b. Find Resolution No. 23-076 exempt from Environmental Review under Sections 15061(b)(3) and 15273 of the California Environmental Quality Act (“CEQA”) Guidelines; and
(3) Adopt Resolution No. 23-076 to establish the new Solid Waste Rates (Rate Schedules) as set forth in Exhibit A of Resolution No. 23-076.

​​Adoption of Proposed Ordinance No. 2444, entitled: ​
(1) An Ordinance of the City Council of the City of Victorville Amending and Revising Portions of Title 10 of the Victorville Municipal Code relating to Rates, Fees, and Charges for City Sewer Service; and ​
(2) Finding an Environmental Exemption​ 
  Recommendation:
Staff recommends that the Honorable City Council:
(1) Conduct the Public Hearing on the proposed adjustments to the City’s Sewer Service Rates; and
(2) Determine if a Majority Protest exists at the close of the Public Hearing, and if no Majority Protest exists;
(3) Find Ordinance No. 2444 exempt from Environmental Review under Sections 15061(b)(3) and 15273 of the California Environmental Quality Act (“CEQA”) Guidelines; and
(4) Introduce Ordinance No. 2444 for adoption and first reading by title only.

Commercial Demand Schedule No. 5    Recommendation:
That the City Council and Board of Directors ratify Commercial Demand Schedule No. 5 in the amount of $6,660,303.44, covering Electronic Fund Transfers No. 336385 through 336508 and Warrant No. 791976 through 792131 for 08/31/2023 through 09/13/2023, per the adopted budget for Fiscal Year 2023-2024 for the period covering July 1, 2023 through June 30, 2024.

Notice of Completion – Guardrail Project    Recommendation:
That the Honorable City Council accept as complete and approve the Notice of Completion for Guardrail Project and authorize the City Manager to execute the Notice of Completion.

Payroll Warrant List    Recommendation:
That the City Council and Board of Directors ratify Payroll Demand Schedule No. 2B for Payroll Period August 4, 2023, through August 18, 2023, in the amount of $2,007,155.52 covering Check Nos. 33641 through 33665, including Vendor checks. Please note employee Check No. 33648 has a live Check and an EFT Advice. Also included are Advice Nos. 304080 through 304605, per adopted budget for Fiscal Year 2023-2024 (period covering July 1, 2023, through June 30, 2024).

Partial Release of the Faithful Performance Security for Case Nos. BLDC21-00009/EROW21-00119    Recommendation:
That the Honorable City Council:
(1) Approve an 80-percent release of the Street Improvements Faithful Performance Security for case Nos. BLDC21-00009/EROW21-00182; and
(2) Accept the street improvements.


9.
Notice of Completion – Green Tree Boulevard Extension    Recommendation:
That the Honorable City Council accept as complete and approve the Notice of Completion for Green Tree Boulevard Extension Project and authorize the City Manager to execute the Notice of Completion.

Fire Department Newsletter    Recommendation:
That the Honorable Council review and file the attached Fire Department Newsletter.

Wellness Center Project – Award of Contract with Apple Valley Communications Inc. for Low Voltage Contractor Services    Recommendation:
That the Honorable City Council approve a low voltage construction contract with Apple Valley Communications Inc. in an amount not to exceed $1,323,485 for the furnishing, delivery and installation of a data network wire/cabling system, paging communications system, access control card reader system, intrusion alarm system and video surveillance system throughout the Wellness Center Campus.

Initiate the Annexation of Tract No. 20280 into Drainage Facilities Assessment District No. 1 and Landscape Maintenance Assessment District No. 6    Recommendation:
That the Honorable City Council:
(1) Approve Resolution No. 23-084 to initiate proceedings to annex Tract No. 20280 into Drainage Facilities Assessment District No. 1;
(2) Approve Resolution No. 23-085 to initiate proceedings to annex Tract No. 20280 into Landscape Maintenance Assessment District No. 6;
(3) Approve Resolution No. 23-086 to preliminarily approve the Drainage Facilities Assessment District No. 1 Engineer’s Report;
(4) Approve Resolution No. 23-087 to preliminarily approve the Landscape Maintenance Assessment District No. 6 Engineer’s Report; and
(5) Approve Resolution Nos. 23-088 and 23-089 setting a public hearing date of November 21, 2023.

13.
Vacation of Water Easement on Tract Map No. 17599    Recommendation:
That the Honorable Board of Directors of the Victorville Water District:
(1) Find the easement vacation not subject to environmental review under the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Sections 15060(c)(2) and 15060(c)(3); and
(2) Adopt Resolution No. VWD 23-013 vacating the easement as described and depicted by the exhibits attached thereto and ordering the recordation of the same.

Approval of CalRecycle Payment Program Authorization Resolution    Recommendation:
That the Honorable City Council adopt Resolution No. 23-080, authorizing the submittal of applications for Payment Programs and related authorizations through CalRecycle.


15.
Approval of CalRecycle Grant Submittal Authorization Resolution    Recommendation:
That the Honorable City Council adopt Resolution No. 23-081, authorizing the submittal of applications for all CalRecycle Grants for which the City is eligible.


16.
Selection Committee's Appointment to the Measure P Oversight Committee     Recommendation:
That Your Honorable City Council appoint the following to the Measure P Oversight Committee:
