The City Council holds its business meetings in public in accordance with the requirements of the Ralph M. Brown Act, its established policies and procedures, and its adopted parliamentary authority. The Council strives to carry out its meetings in an atmosphere of professionalism with full participation by members of the body and the public. As such, the Presiding Officer is empowered to govern City Council Meetings to foster the efficient and fair administration of City business and reserves the right to enforce (or cause to be enforced) the Meeting Rules of Conduct and Decorum as set forth in Chapter 5 of the City Council Policy and Procedures Manual.

The City Council welcomes and encourages public participation and invites the community to attend in person. Now that COVID-19 cases in our area have reduced to a point that social distancing requirements have been lifted, City Council Meetings will be held in-person at City Hall in Council Chambers.  Remote viewing of our Council Meetings is available through YouTube, but public comments must be given in-person at the meeting or in advance as noted below.

Public Comments: Members of the public may submit comments electronically to [email protected] by 4 p.m. the day of the meeting to be distributed to City Council. Participants are invited to address the Council on agendized and non-agendized topics at the beginning of the meeting. Public comments will be no longer than three (3) minutes per community member. Should a speaker conclude their comments prior to the expiration of three (3) minutes, the speaker waives the right to speak for any remaining amount of time. For further information about how to address the Council, please refer to the City’s website at victorvilleca.gov/government/agendas.

1.
An Amendment to the Old Town Specific Plan (OTSP) with an environmental finding of previously assessed to allow for modified land use allowances and development standards within the OTSP located generally on property bounded roughly by the Mojave River and Stoddard Wells Road to the northeast, Eleventh Avenue to the east, Mojave Drive and Verde Street to the south and Interstate I-15 to the northwest    Recommendation:
That the Honorable City Council conduct a public hearing, receive public testimony, and take the following actions:
(1) Find the Specific Plan Amendment previously assessed under the 2018 Old Town Specific Plan Mitigated Negative Declaration; and
(2) Introduce Ordinance No. 2435 for adoption, and first reading by title only, to amend the Old Town Specific Plan; and
(3) Waive a further reading in full of proposed Ordinance No. 2435.

That the Honorable City Council:
(1) Approve an 80-percent release of the Faithful Performance Water, Sewer and Drainage securities;
(2) Accept the water, sewer, and drainage public improvements; and
(3) Approve a 60-percent release of the Faithful Performance Streets Securities.

That the Honorable City Council:
(1) Approve an 80-percent release of the Faithful Performance LMAD, Sewer, and Drainage securities;
(2) Approve the full release of the LMAD Labor & Materials security;
(3) Accept the sewer and drainage public improvements; and
(4) Approve a 60-percent release of the Faithful Performance Streets Securities.

That the Honorable City Council approve the full release of the Monumentation Faithful Performance Security for Tract Map No. 16719.

Full Release of the Water and Sewer Securities for Tract Map No. 15295    Recommendation:
That the Honorable City Council approve the full release of the Water and Sewer Faithful Performance and Labor & Materials securities for Tract Map No. 15295.

6.

That the Honorable City Council:
(1) Approve an 80-percent release of the Faithful Performance Sewer and Drainage securities;
(2) Accept the sewer and drainage public improvements; and

Commercial Demand Schedule No. 17    Recommendation:
That the City Council and Board of Directors ratify Commercial Demand Schedule No. 17 in the amount of $7,788,819.51, covering Electronic Fund Transfers No. 333696 through 333901 and Warrant No. 789321 through 789435 for 02/17/2023 through 03/02/2023, per the adopted budget for Fiscal Year 2022-2023 for the period covering July 1, 2022 through June 30, 2023.

Payroll Warrant List    Recommendation:
That the City Council and Board of Directors ratify Payroll Demand Schedule No. 8A for Payroll Period January 20, 2023, through February 03, 2023, in the amount of $1,819,938.76 covering Check Nos. 33252 through 33272, including Vendor checks. Please note employee Check No. 33257 has a live Check and an EFT Advice. Also included are Advice Nos. 297089 through 297565, per adopted budget for Fiscal Year 2022-2023 (period covering July 1, 2022, through June 30, 2023).

General Plan and Housing Element Annual Progress Reports    Recommendation:
That the Honorable City Council receive and file the 2022 General Plan Annual Progress Report and the 2022 Housing Element Annual Progress Report (APR)

Consultant/Professional Services Provider Agreement with LPA, INC. for the Design of a New Police Station and Civic Plaza     Recommendation:
That the Honorable City Council approve a Consultant/Professional Services Provider Agreement with LPA, INC. (LPA) in the amount of $382,126.00 to develop a conceptual design for a new Police Station and Civic Plaza.

Amending the Measure P Oversight Committee Bylaws    Recommendation:
That the City Council adopt Resolution No. 23-017 amending the Measure P Oversight Committee Bylaws.

13.
Approval of an Attorney Client Contingency Fee Agreement with the Law Office of Bryan M. Grundon    Recommendation:
It is the recommendation that the Honorable City Council consider approval of an Attorney Client Contingency Fee Agreement with the Law Office of Bryan M. Grundon to pursue collection of the judgement amount awarded to the City of Victorville (the “City”) and the Southern California Logistics Airport Authority (the “Authority”) in the KND lawsuit and authorize the execution thereof by the City Manager.

Any action is at the discretion of Your Honorable City Council.

Consideration of proposed City Council Resolution No. 23-018 adopting revisions to the City of Victorville City Council Policy and Procedures Manual    Recommendation:
That the Honorable City Council:
(1) Review and Consider the Proposed Revised City Council Policy and Procedures Manual; and
(2) Adopt Resolution No. 23-018.
